The Hungarian title sheet: what it shows

Every plot of land and every separate property in Hungary has a title sheet, the tulajdoni lap, in the land registry. Buyers, banks and lawyers look at it first. As a seller it is worth reading yours before the first viewer does.

What it records

Under section 11(1) of Hungary's land registry act, the title sheet records the data of the property and the rights and facts related to it, together with the persons entitled to them (Act C of 2021 on the land registry). In practice you will find three kinds of information:

  • The property: location, parcel number (helyrajzi szám), area, type of use.
  • The owners: who owns the property and in what share.
  • Rights, facts and encumbrances: for example a mortgage, a usufruct, an easement, a prohibition on sale, or a pending application.

Who can see it

Under section 14(2) of the same act, anyone may learn the contents of the title sheet and of the registry map, and may request a certified copy. Section 14(3) limits access to the personal data of natural persons: name and address only when the person requesting it identifies themselves and states the purpose.

Why a buyer asks for a recent copy

A copy shows the state of the register on the day it was issued. Banks and lawyers usually want a recent, certified one before a contract or a loan. If you advertise, it helps to have a current copy at hand so that questions about owners and encumbrances can be answered at once.

What to check before you advertise

  1. Are all owners listed who will need to sign? Co-owner, heir, spouse with a share.
  2. Is there a mortgage? If so, find out from the bank how it will be released at the sale.
  3. Is there a usufruct or another right that a buyer will need to know about?
  4. Does the area match what you plan to write in the ad?
  5. Is anything pending? A pending application can delay a sale.

Where to request it

Copies are issued by the land registry offices of the government offices (kormányhivatal), at government windows (kormányablak) and online. The fees and the online channels are set by the current rules; check them with the land registry office before you request.
