Residential Lease in Hungary: What the Written Contract Should Cover
A written lease agreement is not legally required in Hungary, but it is strongly advisable. This article explains what a residential lease contract should contain and why each element matters.
Hungarian law does not require a residential lease to be in writing, but an oral agreement leaves both parties with very limited protection. A written contract is the standard in practice and the only reliable basis for resolving disputes.
Parties and property
The contract should identify the landlord and tenant by full name and ID number (or company registration number for legal entities), and describe the property precisely: address, floor, door number, and the area in square metres. If the property is part of a condominium, note the condominium registration number.
Term and rent
State the start date and, if applicable, the end date. Fixed-term leases end automatically; open-ended leases require notice to terminate. Specify the monthly rent, the currency, the payment deadline (e.g. the fifth of each month), and the bank account to which it should be paid.
Deposit
The deposit amount, the conditions under which it can be withheld, and the deadline for returning it after the tenancy ends should all be stated explicitly. Hungarian practice typically allows a deposit of one to three months' rent.
Utilities and common charges
Specify which utilities are included in the rent and which the tenant pays directly. For condominium flats, state who pays the common charges (közös költség) and how the landlord will be reimbursed if the tenant pays them.
Maintenance and repairs
Define the boundary between routine maintenance (typically the tenant's responsibility) and structural or major repairs (typically the landlord's). State who is responsible for appliances and fixtures.
Inventory
Attach a signed inventory list describing the condition of the flat and its contents at the start of the tenancy. This is the reference document for the deposit return.
Termination
State the notice period required by each party and the conditions under which the contract can be terminated early. Hungarian law sets minimum notice periods that cannot be contracted out of.
