Bitfinex: History, Tether Connection, and MiCA Status

Bitfinex is one of the longest-operating large-volume cryptocurrency exchanges and has been a significant venue for institutional and professional traders. It is closely associated with Tether Limited, the issuer of USDT, the world's largest stablecoin by market capitalisation. Bitfinex is not listed in the ESMA Interim MiCA CASP Register — it does not hold a MiCA CASP licence in the EU.

Regulatory status (verified 12 July 2026): Bitfinex does not appear in the ESMA Interim MiCA CASP Register (CASPS.csv, last updated 3 July 2026). iFinex Inc., the operating entity, is incorporated in the British Virgin Islands and has no EU-authorised CASP entity on record. Founding and Corporate Structure

Bitfinex was founded in 2012 by Raphael Nicolle. The exchange is operated by iFinex Inc., incorporated in the British Virgin Islands. iFinex also controls Tether Holdings Limited, the entity behind the USDT stablecoin, through a shared ownership structure. The close relationship between Bitfinex and Tether has been a persistent subject of regulatory and journalistic scrutiny.

The exchange's leadership has included Jan Ludovicus van der Velde as CEO and Giancarlo Devasini as CFO. Both individuals are also associated with Tether's leadership. The ownership structure of iFinex is not fully publicly disclosed.

2016 Security Breach

In August 2016, Bitfinex suffered one of the largest cryptocurrency exchange hacks in history. Approximately 119,756 Bitcoin were stolen from customer accounts, valued at approximately $72 million at the time of the theft. The exchange socialised the losses across all customers by issuing BFX tokens representing claims on the stolen funds, and subsequently redeemed these tokens over the following months.

In February 2022, the US Department of Justice announced the arrest of Ilya Lichtenstein and Heather Morgan in connection with the laundering of approximately 94,000 Bitcoin linked to the 2016 Bitfinex hack. The DOJ seized approximately 94,636 Bitcoin — the largest financial seizure in the department's history at the time. Lichtenstein subsequently pleaded guilty and cooperated with authorities.

Tether and USDT

The relationship between Bitfinex and Tether is central to understanding Bitfinex's market position. USDT is the dominant stablecoin by trading volume and is used extensively across the crypto ecosystem as a trading pair and store of value. Bitfinex was an early and significant issuer and user of USDT.

In 2019, the New York Attorney General's office investigated Tether and Bitfinex, alleging that Tether had used its reserves to cover an $850 million shortfall at Bitfinex. The matter was settled in 2021 with iFinex paying $18.5 million without admitting wrongdoing, and agreeing to provide quarterly reserve reports for Tether.

Tether has since published regular attestations of its reserves, though these have been the subject of ongoing debate among analysts regarding the composition and quality of the assets backing USDT.

MiCA Status: Not in ESMA Register

As of 12 July 2026, Bitfinex does not appear in the ESMA Interim MiCA CASP Register (CASPS.csv, last updated 3 July 2026). The operating entity, iFinex Inc., is incorporated in the British Virgin Islands and has no EU-authorised CASP entity on record. The MiCA transitional grandfathering period, which allowed pre-existing exchanges to continue operating under national frameworks, expired on 1 July 2026.

This means Bitfinex is not currently authorised to provide crypto-asset services to EU retail clients under the MiCA framework. EU users accessing Bitfinex should be aware that the exchange's regulatory status differs materially from that of fully MiCA-authorised exchanges such as Coinbase, Kraken, Bitstamp, OKX Europe, Bybit EU, Bitpanda, Crypto.com, and eToro.

This is a material distinction, and readers should factor it into their assessment of Bitfinex's regulatory standing in the EU.
